The Board of Supervisors public hearing on the Faulconer Construction
project has been moved to Wednesday, October 27th at 6:00PM!!

On Wednesday, October 20th, ICA's Attorney, Frank Buck, is scheduled to
present our case before a three judge panel of the Virginia Supreme Court.
This panel will rule, within 30-60 days of that hearing, as to whether the
full Virginia Supreme Court will hear our legal case about the original 2001
zoning decision. This legal battle is completely separate from the BOS
review of the Faulconer Site Plan. Thus we still have to keep busy (and
raising money), on both efforts.

Our legal arguments can be found here:

Subject: [EyesOnIvy] Faulconer to appeal to Board of Supervisors

Faulconer Construction is appealing the Planning Commission's 4-2 vote to
reject their final site plan for development of their 27 acre site in the
Ivy Business Park. Their appeal will be heard by the Albemarle County Board
of Supervisors at its October 20th meeting. More details on how you can
help in the month ahead.

Hint... we still need financial support for our SEPARATE legal battle which
is being considered by the Virginia Supreme Court and we need the public to
show up in force to make our concerns clear AGAIN, now to the next level of
government.
